Frequently Asked Questions:

+What is a psychological evaluation for an I-601 or I-601A hardship waiver?
-What is a psychological evaluation for an I-601 or I-601A hardship waiver?

It is a clinical assessment used to support a waiver application when a U.S. citizen or lawful permanent resident would suffer extreme hardship if their immigrant family member is denied legal status or removed from the U.S.

The evaluation is designed to document the psychological, emotional, and practical effects of potential separation or relocation.

+What’s the difference between I-601 and I-601A hardship waivers?

-What’s the difference between I-601 and I-601A hardship waivers?

  • I-601 is used when someone is already outside the U.S. or applying from abroad
  • I-601A is for individuals who are currently in the U.S. but have unlawful presence and need a waiver before leaving for consular processing

The psychological evaluation supports both forms by documenting how the qualifying U.S. relative would be affected.

The qualifying relative (U.S. citizen or lawful permanent resident) — often a spouse, parent, or in some cases, a child — is the person who participates in the evaluation.

They are the one who would experience the hardship, so the report focuses on their emotional and psychological wellbeing.
